These Terms govern your use of Vibephone (the "App") and its associated services. By installing or using the App, you agree to these Terms. If you do not agree, stop using the App.
Vibephone is a tap-to-talk dictation remote for your computer. The iPhone app records short audio clips, transcribes them on your device, and sends the resulting text over a direct Bluetooth link to a companion app (Vibephone Bridge) that you run locally on that computer, which types it for you. Your audio is not uploaded to us.

Vibephone is free to use, with an optional subscription sold through Apple's in-app purchase system:
On both plans a single dictation can be up to 60 seconds long. The Vibephone Bridge companion app for Mac and Windows is free.
Payment & renewal. Subscriptions are billed through your Apple ID and auto-renew monthly unless cancelled at least 24 hours before the current period ends. Manage or cancel at Settings → Apple ID → Subscriptions on iOS.
Restoring a purchase. If you reinstall the App or move to a new iPhone, tap Restore Purchases on the upgrade screen to recover your subscription. There is no account to sign in to.
Refunds. Refund requests are handled by Apple per their refund policy. We do not process refunds directly.

Our Privacy Policy describes what data we collect and how we use it. It's part of these Terms.
The App uses Apple's StoreKit and the open-source WhisperKit speech-recognition library, as described in the Privacy Policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT TRANSCRIPTIONS WILL BE ACCURATE, THAT THE SERVICE WILL BE UNINTERRUPTED, OR THAT THE SERVICE WILL BE FREE OF ERRORS. YOU USE VIBEPHONE AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR US $50, WHICHEVER IS GREATER.
Some jurisdictions do not allow these limitations, so they may not fully apply to you.
We may update these Terms; the "Last updated" date at the top will reflect the most recent revision. Material changes will be surfaced in-app before they take effect. Continued use after changes take effect constitutes acceptance.
You may stop using Vibephone at any time by deleting the App and unsubscribing via Apple. We may suspend or terminate access for violation of these Terms.
These Terms are governed by the laws of the jurisdiction you reside in for consumer-rights purposes, and otherwise by the laws of the State of California, USA, excluding conflict-of-laws rules.
